Renting an apartment in New York City comes with strong legal protections designed to keep tenants safe, informed, and treated fairly. 🛑 1. Right to a Safe & Habitable Home (Warranty of Habitability)
All tenants in NYC have the right to a home that is:
- Safe
- Clean
- Free from pests
- Structurally sound
- Equipped with working heat, hot water, electricity, and smoke/CO detectors
Landlords are legally required to make timely repairs and maintain building safety under NY Real Property Law §235-b.
🔥 2. Right to Adequate Heat & Hot Water
NYC has strict heat and hot water laws.
Heat Requirements (Heat Season: Oct 1 – May 31):
- Daytime: If outside temperature is below 55°F → inside must be at least 68°F
- Nighttime: Inside must be at least 62°F regardless of outdoor temperature
Hot Water Requirements:
- Must be available 365 days a year
- Minimum temperature: 120°F
Tenants can report violations through 311 or HPD.
💰 3. Right to Fair Security Deposit Rules
Under the Housing Stability & Tenant Protection Act (HSTPA):
- Maximum security deposit = 1 month of rent
- Deposit must be held in a separate escrow account
- Must be returned within 14 days after move-out with an itemized receipt for any deductions
- Only damage beyond normal wear and tear can be deducted
These laws protect tenants from excessive upfront fees.

📦 6. Right to Notice Before Eviction or Non-Renewal
Landlords cannot evict tenants without due process.
Tenants have the right to:
